روش رایج برای جلوگیری از مطالبات غیرجاری در نظام بانکی کشور، وجه التزام تأخیر تأدیه است. این راهکار به دلیل تحریف عملی ماهیت وجه التزام و مواجهه با اشکالاتی همچون عدم برخورداری از مشروعیت کافی و برخورد با شبهه ربا، بیتوجهی به اعسار مشتریان و برخورد یکسان با تأخیرکنندگان، راهکار مطلوبی در زمینه حل معضل مطالبات غیرجاری محسوب نمیشود. سؤال اصلی مقاله این است که آیا میتوان در زمینه حل معضل مطالبات غیرجاری به راهکاری دست یافت که ضمن برخورداری از مشروعیت لازم، از کارایی مناسب نیز برخوردار باشد؟ مقاله پیش رو درصدد است با استفاده از روش تحلیلی و توصیفی و با استفاده از منابع فقه امامیه به بررسی این فرضیه بپردازد که راهکار تعزیر مالی مشتریان متخلف میتواند به عنوان روش بهینه مطرح گردد؛ به این بیان که افرادی که با وجود تمکن مالی از پرداخت بهموقع بدهی خود امتناع ورزند، محکوم به پرداخت مبلغی به عنوان تعزیر مالی میشوند؛ در این روش نظام قضایی که عهدهدار مجازات افراد خاطی است، نظام بانکی را متصدی دریافت جرایم مینماید. راهکار دوم وضع جریمه دولتی است؛ در این روش دولت بنا بر نظریه مطلقه فقیه حق دارد جهت حفظ مصالح جامعه و نظم مالی کشور، قوانینی وضع نماید و گیرندگان تسهیلات را مکلف به پرداخت بهموقع دیون و تعهدات مالی نماید و در صورت تخلف از این وظیفه قانونی، ایشان را مکلف به پرداخت مبلغی به عنوان جریمه نماید. دولت میتواند بخشی از تعزیر مالی و جرایم را جهت جبران خسارات وارده به بانکها اختصاص دهد.
The Common method to prevent non-performing receivables in the banking system, is determining considerations for delayed payments. This solution is not a good strategy for some reasons such as practical distort in nature of consideration, lack of sufficient legitimacy, usury problem, inattention to customer insolvency, and same deal with all customers. The main question of the paper is "Is it possible to present a solution for the problem of non-performing receivables that in addition to the necessary legitimacy, also have good performance too?" This article seeks to analyze and describe the method of using the Shiite jurisprudence to investigate the hypothesis that financial ta'zir can be considered as the optimal method. In the other words, people who despite the financial ability refuse to pay their debts on time, are sentenced to pay a financial ta'zir. In this way the judicial system, which is responsible for punishing offenders, delegates the gathering of penalties to the banking system. The second solution is to determine the Governmental penalties. In this way the government in order to protect the financial interests of the society and country, can regulate the facility's rules so that borrowers are required to make timely payment of debts and financial obligations and in case of violation of this legal obligation, they are obliged to pay as penalties. In this method, the government can allocate part of the ta'zir to the banks as loss compensations.
