Case 2: The customer, despite knowing the principle of the contract, is unaware of its elements. Case 3: The customer is unaware of how the contract will be executed. Case 3: the customer is unaware of the proportion of materials in the contract. The results of the present study, which was done by descriptive-analytical method, show that the four mentioned forms do not have the same sentence and even a distinction should be made between the deposit contract and the facility contract. In short, it can be said that the first and second forms of ignorance invalidate the facility contract. In the third case, ignorance does not damage the validity of the contract. There are also types of ignorance in the fourth form. Given that banking contracts are regulated by the central bank and are uniformly available to all banks and in fact it is known, so the ignorance of the customer towards them does not pose a problem in the validity of the contract. However, due to the difficulty of understanding the terms of the contract for most of the bank's customers, the proposed solution is that bank managers explain the main provisions of the contract to customers and other materials in the contracts become law, so there is no need to include them in the text.}, keywords = {Banking contracts,Islamic Banking,Deposits,For-profit facilities}, title_fa = {بررسی آثار فقهی مترتب بر بی‌اطلاعی مشتری نسبت به مفاد قراردادهای بانکی}, abstract_fa = {یکی از مشکلات بانکداری اسلامی، بی‌اطلاعی مشتریان بانک اعم از سپرده‌گذاران و دریافت‌کنندگان تسهیلات نسبت به مفاد قرارداد است که در کل چهار صورت برای آن قابل تصور است: صورت اول: مشتری نسبت به اصل قرارداد و اینکه در قالب کدام ‌یک از عقود شرعی تنظیم شده، بی‌اطلاع است. صورت دوم: مشتری به‌رغم اطلاع از اصل قرارداد، نسبت به ارکان آن بی‌اطلاع است؛ مثلاً در تسهیلات مرابحه نمی‌داند بانک چه کالایی را به وی فروخته است. صورت سوم: مشتری نسبت به شیوه اجرای قرارداد بی‌اطلاع است؛ مثلاً نمی‌داند بعد از دریافت تسهیلات مرابحه باید کالا را به وکالت از بانک بخرد و بعد آن را به عنوان استیفای دین قبض کند. صورت چهارم: مشتری نسبت به مواد مندرج در قرارداد که همان شروط ضمن عقد است، بی‌اطلاع است. نتایج تحقیق حاضر که به روش توصیفی- تحلیلی انجام شده، نشان می‌دهد چهار صورت مورد اشاره حکم یکسانی ندارند و حتی باید بین قرارداد سپرده و قرارداد تسهیلات تفکیک نمود. به ‌صورت اجمالی می‌توان گفت صورت اول و دوم از بی‌اطلاعی سبب بطلان قرارداد تسهیلات است. در صورت سوم، بی‌اطلاعی آسیبی به صحت قرارداد وارد نمی‌کند و بانک مالک سود می‌شود. صورت چهارم نیز اقسامی دارد که در برخی از اقسام امکان تصحیح قرارداد وجود دارد. البته با توجه به دشواری فهم شروط ضمن عقد برای اکثر مشتریان بانک، راهکار پیشنهادی آن است که متصدیان بانک مفاد اصلی قرارداد را به مشتریان تفهیم کنند و سایر مواد مندرج در قراردادها نیز به قانون تبدیل شود تا نیازی به گنجاندن آنها در متن قرارداد نباشد.}, keywords_fa = {قراردادهای بانکی,بانکداری اسلامی,سپرده‌گذاری,تسهیلات انتفاعی}, url = {https://eghtesad.iict.ac.ir/article_245977.html}, eprint = {https://eghtesad.iict.ac.ir/article_245977_6a61c9879e997f9454f8087ee0a160a8.pdf} }
