This importance arises from the new character of these types of contracts. This article examined the future contracts, their rules, and their effects from jurisprudential viewpoint. The results of this study showed that the future contract is an example of mutual commitments to carry out cash sale in the future, so that the parties agree on their commitments at the present to carry out the cash sale in the future and the cash sale takes place at the deadline maturity. About the payment of deposit accounts and daily adjustments of deposit accounts, it can be said that as an example of the terms of this type of contract, the parties first agree to leave some amount of money at the disposal of the clearing chamber to guarantee the contract and secondly, they agree to adjust the amounts of this deposit account according to the future market volatility, so that no party to the contract shall be willing to default on the contract, and, if a party defaults, the other party shall suffer no losses. Also, the Fiqh nature of a cash settlement at the maturity or before the maturity was discussed that the cash settlement before the maturity is an example of transfer of obligation that does not conflict with the principles of Islamic financial principles and cash settlement at maturity is permissible due to its non-conflict with Islamic rules including the La Zarar (the principle of no harm) Rule. In addition, all the basic assets of future contracts were discussed and analyzed based on the properties of the sold item. Future contracts of the commodities, stocks, and foreign exchange are permissible, but the Future contract of climate index is unlawful.  }, keywords = {Future Contract,cash settlement,basic assets}, title_fa = {بررسی فقهی قرارداد آتی، احکام و آثار آن بر مبنای فقه امامیه}, abstract_fa = {بررسی فقهی مشتقات و به‌ویژه قرارداد آتی که ماهیت جدیدی داشته و در بازار سرمایه کشورمان عملیاتی شده است، جایگاه بسیار مهمی در بازار مالی اسلامی دارد. در مقاله پیش‌ رو به بررسی فقهی قرارداد آتی، احکام و آثار آن پرداخته شد. نتیجه‌های حاصل از این پژوهش نشان می‌دهد اکثر قراردادهای آتی از مصداق‌های تعهد در برابر تعهد برای انجام بیع نقد در آینده است به‌‌طوری‌ که طرفین در زمان حال، تعهد به‌انجام بیع نقد را توافق می‌کنند و در سررسید، بیع نقدی اتفاق می‌افتد. درباره پرداخت حساب ودیعه و تعدیل روزانه حساب ودیعه می‌توان گفت که از مصداق‌های شرط‌های ضمن عقد این قرارداد است که طرفین توافق می‌کنند جهت ضمانت عقد؛ اولا،ً مبلغی را نزد اتاق پایاپای قرار دهند؛ ثانیا،ً متناسب با نوسان‌های بازار آتی مقادیر این حساب، ودیعه تعدیل شود تا هیچ طرفی از طرفین قرارداد به نکول در قرارداد تمایل نداشته باشند و اگر طرفی نکول کرد خسارتی به‌ طرف دیگر وارد نشود. همچنین ماهیت فقهی تسویه نقدی پیش از سررسید از مصداق‌های انتقال تعهد بوده که با اصول مالی اسلامی تضاد نداشته و تسویه نقدی در سررسید نیز به‌علت عدم منافات با قاعده «لاضرر» و دیگر قاعده‌های اسلامی بی‌اشکال است. همچنین انواع دارایی پایه قرارداد آتی با استفاده از ویژگی‌های مبیع، بحث و بررسی شد و آتی کالا، سهام و ارز بی‌اشکال بوده؛ اما آتی شاخص سهام اشکال دارد.}, keywords_fa = {قرارداد آتی,تعدیل حساب ودیعه,تسویه نقدی,دارایی پایه}, url = {https://eghtesad.iict.ac.ir/article_15148.html}, eprint = {https://eghtesad.iict.ac.ir/article_15148_f1c7eb736ef8850ba7009ee9ec62f325.pdf} }
