The premise of traditional contract law, characterized by the principle of contractual freedom, is the relative balance of the parties to the contract, otherwise the contractual justice is distorted.In Imami jurisprudence, justice is one of the most important goals of Sharia and has mechanisms that can prevent the occurrence of any unconventional and unfair effects and consequences in contractual relations. According, rules such as La Zarar or La Haraj, the prevention of usury and the principles of Tavazon and Eealleh and authority of the Islamic ruler, allow the Islamic State to intervene within the limits of private contracts and reduce any kind of oppression and injustice.In this article, while examining contract justice using the Malpezzi Model, the index of housing rent control laws is calculated as a measure of the bargaining power of tenants for selected countries and Iran's position in the amount of tenant support is determined. The results of this calculation show that the Malpezzi Index for Iran is zero before the corona pandemic, but with the implementation of some temporary rent control laws during the corona period, it has reached 6.76, which is a wide distance from other successful countries in controlling the rental market. Assuming the application of Islamic rules and proposing the relevant laws in the Malpezzi Model, the Index for Iran became 13.76, which shows that if the Islamic rules are applied in the housing rental market, Iran can be among the top countries in managing the housing rental market}, keywords = {Housing Rental Market,Contractual justice,Islamic economics,Bargaining Power}, title_fa = {عدالت قراردادی از دیدگاه اقتصاد اسلامی: مطالعه تطبیقی قوانین کنترل اجاره مسکن}, abstract_fa = {با توجه به نوسانات شدید بخش مسکن در سال‌های اخیر، شرایط برای اقشار کم‌درآمد و به‌ویژه مستأجرین بسیار سخت شده است. پیش‌فرض حقوق قراردادهای سنتی که علامت مشخصه آن اصل آزادی قراردادی می‌باشد، توازن نسبی طرفین قرارداد است؛ در غیر این صورت، عدالت قراردادی مخدوش می‌شود.در فقه امامیه، عدالت از مهم‌ترین اهداف شریعت، محسوب می‌شود و مکانیسم‌هایی دارد که می‌تواند از بروز هر گونه آثار و تبعات نامتعارف و غیرمنصفانه در روابط قراردادی جلوگیری کند. بر همین اساس قواعدی همچون لاضرر و لاحرج، منع ربا و اصل توازن و اعاله و اختیارات حاکم اسلامی، به دولت اسلامی اجازه می‌دهد در حدود قراردادهای خصوصی مداخله و بروز هر نوع ظلم و بی‌عدالتی را کاهش دهد.در این مقاله ضمن بررسی عدالت معاوضی با استفاده از مدل مالپزی (Malpezzi)، شاخص قوانین کنترل اجاره مسکن به عنوان معیاری از قدرت چانه‌زنی مستأجران برای کشورهای منتخب محاسبه و جایگاه ایران در میزان حمایت از مستأجران مشخص می‌گردد. نتایج این محاسبه نشان می‌دهد شاخص مالپزی برای کشور ایران تا قبل از پاندمی کرونا صفر است؛ ولی با اجرای برخی قوانین موقت کنترل اجاره در دوره کرونا به عدد 6.76 رسیده که فاصله گسترده‌ای با دیگر کشورهای موفق در کنترل بازار اجاره دارد. در ادامه با فرض اعمال قواعد اسلامی و پیشنهاد قوانین مربوطه در مدل میزان شاخص فوق برای کشور ایران برابر 13.76 به دست ‌آمد که نشان می‌دهد در صورت اعمال قواعد اسلامی در بازار اجاره مسکن، ایران می‌تواند در میان کشورهای برتر در مدیریت بازار اجاره مسکن قرار گیرد.}, keywords_fa = {بازار اجاره مسکن,عدالت قراردادی,اقتصاد اسلامی,قدرت چانه‌زنی}, url = {https://eghtesad.iict.ac.ir/article_248239.html}, eprint = {https://eghtesad.iict.ac.ir/article_248239_f3687a3878d9879c600da9de17d23279.pdf} }
