Jurisprudential examination of earning profit without accepting capital risk

Abstract
Earning profit in Islam is accepted and recommended to meet the necessary and conventional needs. But we are faced with an important question in relation to earning profit: Is it permissible to earn profit from capital - both cash and non-cash - without accepting capital risk? The answer to this question is by analytical and descriptive method and by referring to jurisprudential evidences and evidences in different chapters of jurisprudence, such as the sanctity of renting land to the majority as opposed to farming the land, the sanctity of seeking profit in a loan contract, the inadmissibility of earning profit in Mudarabah under the condition of capital guarantee and etc., it becomes clear that it is not permissible to earn profit without accepting capital risk. Therefore, this article should be taken into consideration as an important jurisprudential rule under the title "Rule of interest" and it will have important effects in the economic system of Islam.
