A Comparative Study of the Distribution and Property law of the Oil and Gas Resources in United States, Based on the Theory of Distribution before the Production of Islamic Economics

Abstract
Land and mineral wealth are the part of capitals of each country that the type of distribution and property law of them plays an important role in the economic relations. Specially, oil and gas resources have particular importance. The United States is a country that has a distribution mechanism that is Special for the capitalist economy, and its oil and gas rights are, as some admittedly, one of the most advanced branches of law. On the other hand, the theory of distribution before the production of the Islamic economy has devoted to various aspects of the ownership of natural resources. In order to clarify the property law of the oil and gas resources and to better understand their distribution system, the distribution mechanism and property law of oil and gas resources in U.S evaluated based on the theory of distribution before the production of the Islamic economy by using an adaptive method. Finally it was criticized in the "private property", "citizenship ownership of resources from land ownership", "capitalist production" and "loss of the opportunity for popular productivity" Based on the above theory.
